            Shri G. P. Upwanshi, learned counsel with the appellant.

As per Shri Justice Shantanu S. Kemkar :                       

            This appeal arises out of the order dated 09.05.2013 passed by the District Consumer Disputes Redressal Commission, Balaghat (for short ‘District Commission’) in C.C.No.18/2013 whereby the District Commission has dismissed the complaint filed by the complainant/appellant.

2.                After arguing for some time, learned counsel for the respondents made an offer that the respondents will repair free of cost the subject motorcycle bearing registration number MP-50 D-4469 which is with the complainant/appellant, on the complainant’s/appellant’s handing over possession of the same to the respondent no.3.

3.                It has also been categorically stated on behalf of the respondents that they shall ensure the repairs of the subject motorcycle to the satisfaction of the complainant.

4.                Learned counsel for the complainant/appellant as also the appellant who is also present have accepted the offer of free of cost repair of the said motorcycle to the satisfaction of the appellant, made by learned counsel for the respondents.

5.                In view of the aforesaid we direct the appellant to handover the motorcycle to the respondent no.3’s-workshop within 10 days and on getting the same the third respondent shall repair the motorcycle free of cost to the satisfaction of the appellant within three weeks from the date of getting possession of the same.

6.                The appellant shall give a satisfaction note, if the motorcycle is found in motorable condition after getting a test ride of the same.  

7.                With the aforesaid directions, this appeal stands disposed of with no order as to costs.
