1. Pleadings of the Complainant.
The complainant purchased for Rs. 1,990/- 60 tablets of an ayurvedic proprietary medicine named "Hammer of Thor" from the opposite party after seeing their advertisements in Facebook. According to the advertisement of the opposite party if the medicine won’t give result after 30 days of consumption, 100% cost will be refunded. Since the medicine failed to give the promised result, the complainant sought refund from the opposite party. Then they demanded pre & post usage testosterone report as on some specific dates which is not practically possible. Hence the complainant approached this Commission seeking refund of Rs. 1,990/- along with a compensation of Rs. 10,000/-.
2. Notice was issued to the opposite party, but they didn't enter appearance and hence was set ex-parte.
3. The complainant didn't file proof affidavit or mark any documents as evidence in support of his pleadings even after directing him to file proof affidavit.
4. Since the complainant complainant failed to prove a prima facie case against the opposite party, the complaint is dismissed.
