Brief Facts of the case
Mrs Preeti Tyagi, adult, complainant, wished to get her unwanted hair growths removed at chin and neck region, so she contacted Health Sanctuary who assured her for total removal of unwanted hairs through laser procedure. Complainant agreed and paid Rs 8000/- for 6+2 sittings. As per terms and conditions of Laser treatment, complainant has to come at opponent’s address every month. Sittings started. But her chin hairs were growing very fast so she was advised to visit twice a month. Complainant was satisfied with the procedure.

It was alleged that due to faulty hair removing machine, she sustained some skin injury at her chin. The complainant asked for the refund of her amount paid but opponent assured for extending their sitting schedule till her full satisfaction.
As complainant was not getting desired results, so again refund of amount was demanded. There was no response from the respondent. Legal notice was served and later case was filed.
After pursuing the records, notice was served to respondent. Respondent did not file their written version in time. On request from respondent, opportunity was given conditionally ie after paying the cost, written version will be taken on record. But respondent did not pay cost hence their written version was not taken on record. Complainant filed evidences on affidavit which are not controverted by respondent.
We have gone through the records. The evidences placed by the complainant is uncontroverted on record. There is specific allegation that there is no relief to the complainant after the treatment. The complainant has alleged on oath that there is increase in the growth of hairs. The act of respondent amount to unfair trade practice.
We allow this complaint. The respondent is directed to refund to the complainant the amount deposited by the complainant with 9% interest from the date of filing of this complaint till paid. Complainant shall also be paid Rs 10,000/- as compensation which shall also include the cost of litigation.
The order copy be sent to the parties as per act and file be consigned to the record room.
