Ten Complainants namely, i) Shyamali Chakraborty, ii) Shipra Chakraborty, iii) Rina Chakraborty, iv) Sonali Chakraborty, v) Champa Chakraborty, vi) Asit chakraborty, vii) Bishakha Maiti, viii) Raghu Smanta, ix) Shrabanti Das, & x) Malati Khamrui. by filing a joint complaint petition U/S 12 of the C .P. Act, 1986 ( as amended up to date ) have prayed for a direction to be given upon the o.ps. to pay total amount of Rs. 50,000/- as compensation for causing mental pain and agony by way of not supplying the agreed materials to them along with litigation costs and other reliefs as the Forum may deem fit and proper. 2. Brief facts of the case is that, complainants paid 12 monthly installments to o.ps. totalling Rs. 21,750/- for purchasing different household goods like D .V.D. player, water purifier, refrigerator etc. through one agent of o.p., namely, Siddha Chakraborty ( starting on and from June & July, 2012 ) vide annexures money receipts. But even after the maturity date, which fell in June and July of 2013 on different dates for different complainants, o.ps. failed to deliver the agreed goods to them. Complainants wrote a request letter on 15-09-2013 to o.p. asking for the return of total amount of Rs. 21,750/-, but o.p. remained silent and neither delivered the goods nor returned their investment. Finding no other alternative and being frustrated, complainants filed this instant petition jointly alleging deficiency in service and unfair trade practice against o.ps. along with the aforesaid prayers. 3. Notices were served. But o.ps. neither appeared and nor filed any written version. Accordingly, case heard ex parte. 4. Upon pleadings of both parties two points arose for determination : i) Is there any deficiency in service on the part of the O.Ps. ? ii) Whether the complainants are entitled to get any relief as prayed for ? DECISION WITH REASONS : 5. Both the points are taken up together for consideration. We have carefully gone through the petition of complaint and its Annexure. Complainants had deposited their money with great hope to get their most useful household materials. But o.p. have simply adopted unfair trade practice. They have received money all in time, but did not keep their promise. It should always be kept in mind that business can only flourish if consumers are satisfied fully. We have seen o.ps.’ big departmental stores in and around Kolkata and other towns. How they can behave in such an irresponsible manner for such a small amount of Rs. 21,750/-? Even they have not cared to appear before this Forum after receiving summon. And no written version has been filed by them. It clearly shows that they have nothing to put forward in their favour. So, we have no difficulty to believe the unchallenged testimony of the complainants. Accordingly, the case succeeds on merit. Hence, O R D E R E D That the C. C. Case No. 422 of 2013 ( HDF 422 of 2013 ) be allowed ex parte with costs against the O.Ps. That the O.Ps. are jointly and severally directed to refund Rs. 21.750/- to the complainants as per their deposits. That the complainants do get an award of Rs. 10,000/- as compensation i.e., Rs. 1,000/- each and Rs. 2,000/- as litigation costs. The o.ps. are directed to pay the entire amount of Rs. 33,750/- to the complainants within one month from this order i.d., the entire amount shall carry an interest @ 10% p.a. till actual payment. The complainants are at liberty to put the decree into execution after expiry of the appeal period. Supply the copies of the order to the parties, as per rule. DICTATED & CORRECTED BY ME.
