It is hereby ordered that the present Appeal is allowed and accordingly the impugned Order dated 02/09/2013 passed by Ld. Forum, North Goa in Complaint No. 72/2013 is hereby set aside. Consequently, we do hereby remand this case to Ld. Forum with the direction that the Forum shall admit the present complaint registered under Complaint No. 72/2013 and issue notices/summons to the Opposite Parties therein. It is also hereby directed that all objections including point of limitation etc. shall be decided by the Lower Forum only after the stage of evidence is over and towards the conclusion of the case. The Appeallant herein shall appear before Ld. District Forum, North Goa on 19/06/2014 at 10:30 a.m. The present complaint shall be decided by the Ld. Forum as expeditiously as possible, keeping in view the mandate of Consumer Protection Act, 1986. No costs.
