In result, the case succeeds.

Hence,

Ordered

That the instant case be and the same is allowed on contest with cost against the OPs.

          OPs are jointly and severally directed to pay the complainant a sum of Rs.30,000/- with deduction of 10 percent thereof as non-standard basis as service charge and other miscellaneous expenses within one month from the date of passing this judgement.

          OPs are also directed jointly and severally to pay an amount of Rs.10,000/- to the complainant as litigation cost within the said stipulated period.

Failure to comply with the order will entitle the complainant to put the order into execution u/s. 25 read with Section 27 of the C.P. Act and in that case OPs are liable to pay penal damages at the rate of Rs.5,000/- each to be paid to this Forum till full and final satisfaction of the decree.
