ORDER:
Today the case was fixed for filing evidence on behalf of the complainant.
Sh. Sagar Bhatia, counsel for Op no.1 has suffered a statement that “ the OP no. 1 will refund the amount of Rs. 1,30,000/- as full and final settlement amount for insurance premium towards certificate No. PP00018203ZAR00 under loan no. HOU-FBD-0822-1021391 of the complainant to OP no. 2 i.e. PNB Housing Finance limited being master policy holder of Op no. 1. The amount will be processed within 30 days.”
On the other hand, Sh. Aman Bhardwaj, complainant in person has suffered a statement that “I have heard the statement of counsel for Op no. 1 and accept the same. I accept the amount of Rs. 1,30,000/- as full and final settlement amount. The OP no. 2 may kindly be directed to adjust the premium amount towards the outstanding loan amount. Further Op no. 2 may be directed not to insist the complainant for getting the outstanding home loan insured. Now, I do not want to proceed with the present complaint and withdraw the same being fully satisfied.”
On the basis of the statement of both the parties, the Commission is of the opinion that the complaint is disposed off with the direction to opposite party No.1 to deposit the above said amount in the loan account of the complainant. There are no order as to costs. Compliance
of this order be made within 30 days from the date of receipt of copy of this order. Copy of this order be sent to the parties concerned free of costs. File be consigned to the record room.
