As the premium paid by the deceased while obtaining the insurance policy was less than Rs.1 crore, the complaint could be filed only before the District Consumer Disputes Redressal Commission and not before the State Consumer Commission as held by the Hon’ble National Consumer Commission, New Delhi in C.C. No.833 of 2020, M/s Pyaridevi Chabiraj Steels Private Limited Vs. National Insurance Company Limited, decided on 28.08.2020.

2.      Faced with the above, learned counsel for the complainant states that he may be allowed to withdraw the complaint with liberty to approach the learned District Consumer Commission by filing the complaint on the same cause of action.

3.      Dismissed as withdrawn with liberty as mentioned above.
