1. The case of the complainant in brief is that he had deposited an amount of Rs.15,000/- on 27-09-2012, Rs.14,775/- on 12-10-2013 and Rs.15,400/- on 25-02-2014 with the opposite party's branch at Kottakkal and Manjeri. The total amount he deposited is Rs.45,175/-. The 1st and 2nd payment by the complainant was at the Kottakkal branch of the opposite party and the 3rd payment was made at the Manjeri Branch. When the complainant approached the opposite party for making the payment of the 3rd instalment they informed the complainant that the second instalment was not paid by the complainant. According to them no such payment was seen as per the records. After that the complainant had gone to the office of the opposite party at Kottakkal and it was found closed. He approached this Forum for getting back the amount of Rs.45,175/- which he deposited with the opposite party's Bank along with cost and compensation.
2. Even though notice from this Forum served to the opposite parties they did not appear and represented. The name of the opposite parties were called and was set exparte. Complainant was examined as PW1, documents marked as Ext.A1 to A5. No contra evidence was adduced on the side of the opposite party.
3. The complainant is a consumer and there has been chronic latches and deficiency on the part of the opposite parties. The act of the opposite parties made the complainant much difficulty and hardships. By believing the sweet words of the opposite party the complainant deposited the above said amount with much expectations. But all are in vain. The opposite party is a well established Bank having branches all over India. The consumer of such as establishment should not be put to difficulties.
4. Therefore, we hereby order that the opposite parties shall pay Rs.45,175/-(Rupees Forty five thousand, one hundred and seventy five only) with interest @ 10% per annum from 27-09-2012 till the date of payment along with Rs.5,000/-(Rupees Five thousand only) towards compensation for the mental agony and hardships. Both the opposite parties are jointly and severally liable to compensate the complainant. The order shall be complied within one month from the date of receipt of the copy of this order.
