The Case is taken up for admission hearing. 

Perused the Petition of complaint and the annexure as filed by the complainant. Considered.

On careful consideration of the petition of complaint, it appears that only the Proforma OP-4 is running its office under P.S.-Park Street but the complainant has no claim against the Proforma OP-4.  Neither the complainant nor the OPs-1 to 3 are residing or running their business in the territorial jurisdiction of this Commission. The complainant placed this claim application mainly against the OPs-1 and 2, Insurance Company who are outside the jurisdiction of this Commission.

Considering all these things, this Commission is of view that the complainant has include the OP-3 & 4 in the cause title of the petition of complaint just to file this case before this Commission i.e. DCDRC, Unit-II, Kolkata.  So, we think that this Commission is not in a position to admit the case due to want of territorial jurisdiction

Hence, the case is not admitted and rejected with a liberty to the complainant to file afresh before the proper Forum.

The MA/114/2024 filed by the complainant is thus disposed of and rejected accordingly.
