Complaint against OP No.3 dismissed vide order dated 28.06.2021.

AWARD

1.   Vide his separate statement already made on 11.11.2022, Sh.Nitin Thatai, Counsel for OP No.1 & 2 has stated that the matter has been settled between the parties with the term that OP No.1 & 2 shall refund an amount of Rs.3,00,000/- to the complainant in full and final settlement within a period of one month subject to submitting the RTGS details by the complainant with him and in case the aforesaid amount is not paid by OP No.1 & 2 within one month, they shall be liable to pay the aforesaid amount alongwith interest @ 12% p.a. from the date of filing of present consumer complaint and the policy which is already lying terminated would become redundant. Vide his separate statement already made on 11.11.2022, Sh.Vansh Malhotra, Counsel for Complainant has admitted the statement of counsel for OP No.1 & 2 and prayed that the complaint be disposed off in terms of aforesaid settlement in the National Lok Adalat on 12.11.2022.

2.   In view of the statement of the counsel for the parties and in terms of the settlement, the complaint stands disposed of by passing the following order:-

     (i)  OP No.1 & 2 shall refund an amount of Rs.3,00,000/- to the complainant in full and final settlement within a    period of one month from 11.11.2022 subject to submitting the RTGS details by the complainant with the counsel for    OP No.1 & 2.

     (ii) In case the aforesaid amount is not paid by the OP   No.1 & 2 within the stipulated period, then OP No.1 & 2 shall be liable to pay the same alongwith interest @ 12%     p.a. from the date of filing of present consumer complaint i.e. 06.07.2020 till its realization and the    policy which is already lying terminated would become redundant.

 

3.   The award is accordingly passed.

4.   Certified copies of this order be sent to the parties free of cost. The file be consigned.
