Final Order / Judgement

Present:      Complainant in person with counsel Sh. Deepak Sangwan, Adv.

                   Sh. Avinash Sardana, Adv. for OP.

 

          Today the case is fixed for argments, but the learned counsel for OP has made a statement before this Commission that the matter has been compromised between the complainant and the OP company, according to which the OP company will pay a sum of Rs. 18,57,000/- to the complainant in full and final settlement of their claim, within 45 days, immediately after cancellation of R.C. of insured car and handing over the insured damaged car by the complainant to the OP company.

        The complainant has also made a statement that he has heard the statement of learned counsel the OP and agree with the same.  He further states that the complainant will be bound to get R.C. of insured car cancelled and for handing over the insured damaged car to the OP company and prayed for to decide the present complaint accordingly. 

       Statement of both the parties in this regard have been recorded separately. 

         Heard.  In view of the statement made by both the parties,      it is ordered that the parties shall be bound by their own statements. Accordingly, the complainant will be bound to get the R.C. of insured car cancelled and also handover the insured damaged car to the company under their valid receipt. The OP is also directed to pay Rs. 18,57,000/- (Rupees Eighteen Lakh Fifty Seven Thousand only) to the complainant within a period of 45 days immediately after receipt of cancelled R.C. and insured damaged car. However, in case of default after 45 days of receipt of cancelled R.C. and insured damaged car from the complainant, the OP shall be liable to pay interest @ 9% per annum on aforementioned amount Rs. 18,57,000/- to the complainant from the date of default, till realization of final payment to the complainant.

            The present complaint stands disposed off accordingly, being compromised.

          Certified copies of this order be supplied to the parties free of costs. 

          File be consigned to the record room, after due compliance.
