Final Order / Judgement

Present:      Complainant Shree Bhagwan in person with counsel Sh. Vikas Kumar, Adv.

                   Sh. Satender Ghanghas, Adv. for OPs.

 

          Case taken up on the application moved by counsel appearing on behalf of OPs.  In support of contents of his application, the counsel for OPs has made a statement that the matter has been compromised between the parties whereby the OPs company will pay a sum of Rs. 38,000/-to the complainant in full and final settlement of the claim, within 45 days.

        The complainant has also made a statement that he has heard the statement of learned counsel the OPs and agree with the same.  He further stated that now he wants to withdraw the present complaint in view of the statement made by learned counsel for OPs and prayed for to decide the present complaint accordingly. 

       Statement of both the parties in this regard have been recorded separately. 

         Heard.  In view of the statement made by both the parties, the present complaint stands dismissed as withdrawn being compromised and the application filed by the OPs stands disposed of accordingly.  The parties shall be bound by their own statements. Accordingly, the OPs are directed to pay Rs. 38,000/- (Thirty Eight thousand only) to the complainant within a period of 45 days from the date of this order and in case of default, the OPs shall be liable to pay interest @ 9% per annum on aforementioned amount Rs. 38,000/- to the complainant from the date of default i.e. after 45 days from the date of this order, till realization of final payment to the complainant.

          Certified copies of this order be supplied to the parties free of costs. 

          File be consigned to the record room, after due compliance.
