Naresh Kumar son of Shri Neki Ram, resident of Kheri Sakra near Sarkari School, Kaithal, aged about 34 years.

1.     HDFC Ergo General Insurance Co.Ltd. 1st floor, HDFC House,165/166 backbay Reclamation, H.T. Parekh Marg, Church Gate, Mumbai-300020 through its Managing Director.

 

2.     HDFC Ergo General Insurance Co.Ltd. SCO no.237, 2nd floor, Sector-12, Karnal through its Branch Manager.

Complaint under Section 35 of Consumer Protection Act, 2019.

                Shri Sanjeev Vohra, counsel for the OPs.

 

                Today the case was fixed for evidence of complainant subject to the fourth last opportunity.  None has appeared on behalf of complainant nor evidence on behalf of complainant has been tendered. The position remained the same on the last two adjourned dates. A careful perusal of the file reveals that the written version on behalf of OPs has been filed on 16.07.2021 and thereafter the case was adjourned for evidence of complainant but till today, complainant has failed to conclude his evidence after availing several opportunities including four last opportunities. It appears that complainant is no more interested to pursue his case.

              Hence, in view of the above circumstances, the present complaint is hereby dismissed for want of prosecution. However, the complainant is at liberty to file fresh complaint on the same cause of action in the court of competent jurisdiction, if so desire. Parties concerned be communicated of the order accordingly and file be consigned to the record room.
