Case was fixed for arguments, but a compromise has been arrived between the complainant and opposite party No. No. 1. On 08.01.2020, the learned counsel for the opposite party No. 1 made a statement recorded separately that the Insurance Company offers a sum of Rs. 12,70,000/- as full and final settlement of the claim put forth in the present complaint. The learned counsel for the complainant also suffered statement that he has heard the statement of learned counsel for OP No. 1 and the same is acceptable to the complainant as full and final settlement and further stated that the complaint may be disposed of accordingly.

In view of the above statements, the present complaint is disposed of with the direction to the opposite party No. 1 – HDFC Ergo General Insurance Company Limited to pay a sum of Rs. 12,70,000/- to the complainant within  15 days from the receipt of copy of this order, failing which  the complainant will be entitled to get interest thereon @ 9% per annum from the date of filing of the complaint till realization.  File be indexed and consigned to record room.
