Application of Ms. Kimmy Garg wife of deceased complainant for her substitution in place of her deceased husband taken up for consideration. She submits that there is no other LR apart from her.
Submissions made by both sides heard. Mr. Rajesh Kumar Gupta Learned Counsel for OP has no objection if Ms. Kimmi Garg wife of deceased complainant is substituted in place of her husband and she is allowed to procced with the present complaint.
Learned counsel for both the sides submits that the matter has been amicably settled fully and finally for Rs. 5 Lacs (Rs. 5,00,000/-). Ms. Kimmi Gard wife of deceased complainant she has agreed to accept Rs. 5,00,000/- in full and final satisfaction of her claim.
It is submitted by both the sides that complainant will comply with certain procedural formalaties within a week of passing of this order and thereafter OP Insurance will release the payment within one and a half month.
Learned counsel for OP insurance submits that after submission of requisite documents by complaint to OP, OP Insurance will pay the amount within one-and-a-half-month maximum.
In view of the statements made by both the sides the complaint is disposed off as settled. It is ordered that Ms. Kimmy Garg is substituted in place of her deceased husband Mr. Ajay Garg. OP Insurance is directed to pay her an amount of Rs. 5 Lacs (5,00,000/-) as full and final settlement of her claim within one-and-a-half-month after submission of necessary documents required for release of payment by her with OP Insurance and in case OP Insurance delays the payment even after one and a half month of submission of necessary documents by her it will be liable to pay interest at the rate of 9% per annum on the amount due from the date of default till the date of payment. File be consigned to record room.
