            Both the parties are present by filing haziras through their respective Ld. Advocates.  Today is fixed for submitting the revalidated cheque by the jdr. 

Today the Ld. Advocate of the Dhr. files a petition praying to pass necessary order to hand over the banker’s cheque as submitted by the Jdrs.  On perusing the record it appears that on 21.8.2017, the Jdr. has submitted the revalidated cheque of HDFC Bank being No.615350 dated 13.7.2017 amounting to Rs.31,409/- in the name of the Dhr., Jit Singha Roy and said banker’s cheque was kept in safe custody of this Forum for handing over the same to the Dhr. on demand.  Today on behalf of the Dhr. demand has been placed.  On call the Dhr. Jit Singha Roy himself is present and he files one photocopy of his voter identity card along with original.  The photocopy of voter identity card is compared with the original.  Let the original voter identity card be returned to the Dhr. Jit Singha Roy.  The Ld. Advocate, Sanyuk Banerjee has identified the Dhr. Jit Singha Roy.

            We are satisfied that the Dhr. Jit Singha Roy himself is present.  So, there is no bar to hand over the banker’s cheque as mentioned above to the Dhr. on proper receipt.

            On call the Dhr. asked before this Forum that he is satisfied with this amount and has prayed to dispose of this execution case on full satisfaction.  Hence, it is

that the execution case be and the same is disposed of on full satisfaction. 

Let the copies of this order be supplied to the parties free of cost.
