O R D E R

1.    This is an appeal filed U/s.41 of CPA 2019 by Complainant/Appellant aggrieved by the order dtd.18.01.2024 passed in CC/18/2023 on the file of Chitradurga District Commission. (Parties to the appeal henceforth are referred to their rank assigned to them by the District Commission).

2. The Commission examined grounds of appeal, impugned order, appeal papers and heard.

3. Learned counsel for Appellant/Complainant submits that United India Insurance company had issued the Master policy in respect of accidental death of Rs.15 lakhs to Global Assurance Pvt., Ltd., and the certificate of insurance issued in the name of the husband of Appellant who died on 21.03.2021. However, inadvertently, the Complainant before the District Commission failed to file case against United India Insurance company and Global Assurance Pvt., Ltd., and wrongly impleaded HDFC Ergo General Insurance Co., Ltd., It is therefore, found satisfied to dispense with issuance of notice of this appeal to be served on Respondent/OP to avoid further delay. Consequently remanded back the matter to the District Commission to allow the Complainant to implead United India Insurance company and Global Assurance Pvt., Ltd., as parties to the Complainant and allow the Complainant to amend the complaint suitably. Accordingly appeal stands disposed of, as a result, impugned order stands set aside. The District Commission is directed to decide the complaint affording opportunity to both parties. It is needless to say in accordance with law as early as possible not later than 3 months from the date of receipt of this order.
