ORDER

Complainants/applicants filed a complaint before the State Commission seeking compensation of Rs.30 Lacs before State Consumer Disputes Redressal Commission, UT Chandigarh.  State Commission was of the opinion that the claim of Rs.30 Lacs lodged by the applicants was exaggerated and speculative.  Applicants were advised to file the complaint before the District Forum.  Applicants withdrew the complaint with liberty to file the same before the District Forum.  They, thereafter, filed the complaint before the District Forum reducing the claim to Rs.9.5 Lacs. 

          District Forum awarded a compensation of Rs.50,000/-.  Applicants have moved this transfer application seeking transfer of the case as the State Commission in the earlier order passed by it had expressed its opinion to the effect that the claim lodged by the applicants was ‘exaggerated and speculative’.  Notice was issued to the respondent.  Counsel appearing for the respondent has no objection to the transfer of the case to any other State Commission.

In view of the statement made by counsel for the respondent, appeal No.209/2012 filed before the State Consumer Disputes Redressal Commission, Chandigarh is transferred to State Consumer Disputes Redressal Commission, Punjab. 

State Consumer Disputes Redressal Commission, Chandigarh is directed to transfer the case file of appeal No.209/2012 to the State Consumer Disputes Redressal Commission, Punjab.

          State Consumer Disputes Redressal Commission, Punjab on receipt of case file shall dispose of the appeal in accordance with law.

          Nothing stated herein be taken as an expression of opinion.
