30.6.2015 Present:- Sh.Vikas Gupta, counsel for complainant.
Sh.Ashu Bansal, counsel for opposite parties.
Statement of Sh.Vikas Gupta, counsel for complainant is recorded, wherein he has admitted that the account of the complainant stands closed. However, he has further stated that the complainant has been harassed for a long period, therefore, he should be granted compensation for this harassment.
We have examined the matter. The case of the complainant is that he was running the business of contractorship and obtained an overdraft facility from opposite parties. In the last week of February, 2014, the complainant cleared the account and requested opposite party No.3 to close the account. It is alleged that the account was not so far closed. The complainant prayed for the refund of Rs.3300/-; Rs.11,063.85/- debited from his account and compensation for Rs.50,000/-.
It is not disputed that the debited amount was credited in the account of the complainant and account has been closed. There is nothing on record to prove that the complainant is also entitled for compensation. Moreover the account of the complainant was for business purpose. Therefore, keeping in view all the facts, the present complaint is dismissed infructuous. File be consigned to the record room.
