ORDER
By Ajit Pal Singh Rajput, President. The ld. counsel for the complainant has submitted that the JD/OP has not fully complied with the order dated 27.10.2014 passed by this Forum. He stated that the amount of Rs.25,029/- has not been paid by the JD/OP.
2. On the other hand, the ld. counsel for the JD/OP has stated that this Forum has not directed the OP to refund the sum of Rs.25,029/- as alleged by the complainant. The ld. counsel further stated that JD/OP has placed on record copy of notice dated 09/05/2014, whereby the complainant was asked to deposit the outstanding amount towards her credit card issued by OP. He argued that moreover the amount was recovered by exercising due process of law i.e “Bankers lien and Right of Setoff”. The ld. counsel further submitted that this Forum vide order dated 27.10.2014 had ordered “We also direct the OP to refund any charges charged for the abovementioned transaction” the Forum has not ordered to refund the sum of Rs.25,029/- .
3. We have heard the ld. counsel for both the parties and have also gone through the documents placed on record. In our view the JD/OP has complied with the order of this Forum. The submissions of the ld. counsel for the complainant cannot be accepted as this Forum has no power to review or recall its own order.
4. Accordingly in view of our aforesaid discussion, the JD/OP has complied the order passed by this Forum. Thus, the present execution application is disposed of.
