ORDER

 

               This is a complaint under Section 35 of the Consumer Protection Act.

3.             On notice, OPs No. 1 & 2 appeared and filed its written version raising preliminary objections with regard to maintainability; cause of action; locus standi; jurisdiction and concealment of true and material facts. On merits, it is contended that on the request of the complainant, the OPs settled his credit liability for amounting of Rs.35,400/- against the total outstanding of Rs.45,375/- on his credit card.  The complainant was conveyed regarding the settlement by way of SMS and by way of letter dated 25.11.2019 having the detailed scheduled of the settlement and the same was sent to the complainant through track on courier on 03.12.2019.  The complainant had not paid the settlement amount as per the terms and conditions of the settlement. The allegations made in the complaint have been denied and prayed for dismissal of the complaint.   

4.             The complainant has tendered into evidence affidavit of complainant Ex.CW1/Ao and documents EX. C1 to Ex. C13 and closed the evidence on 14.02.2022 by suffering separate statement.

5.             The learned counsel for the OPs   has tendered into evidence affidavit Ex. RW1/A and documents EX. R1 and Ex. R3 and closed the evidence on 17.08.2023 by suffering separate statement,

6.             We have heard the learned counsel for the parties and have gone through the record available on the file carefully.
