Kachrulal Agrawal-appellant is present in person.

Learned counsel for respondent submits that the parties have settled the matter out of the Court and in response  to that the respondent-Bank has delivered a cheque of Rs.10,000/- to the appellant, therefore, the appellant does not wish to proceed with this appeal.

Shri Agrawal admits the above statement made by counsel for respondent.

In view of the settlement arrived at between the parties and on the request of appellant, this appeal is disposed of as not pressed.
