In pursuance of an attempt made for settling the dispute between the parties, the parties have arrived to an understanding where in the complainant conceeded his default in payment of certain instalments payable to the O.Ps. and thus has come forward to pay the instalments due as on May 2008 and issued three D.Ds for Rs.7,761/-, 2^nd D.D. for Rs.3,102/- and 3^rd D.D. for Rs.14,049/- which according to the counsel for the opponent satisfied the claim of the opponents towards instalments due till the end of May 2008. With this the counsel for the opponent has agreed to redeliver the motor bike to the custody of the complainant with all its accessories. However, the counsel for the opponent submitted to caution the complainant to continue to pay the remaining instalments as and when fall due without giving any scope for them to resort to the same method of seizer. As we have noticed in this case the complainant committed default in payment of certain instalments. since the matter is ended amicably this complainant do not survive and with this the complainant has been cautioned to be prompt in payment of the balance instalments. The counsel for the opponents reports the receipt of three D.Ds with this the complaint is closed. The motor bike shall be redelivered on 09/06/2008.
