ORDER

Heard the counsel for the complainant regarding admission. The complainant has filed this complaint relying upon the settlement document dated 26/08/2009 under which she submits that there had been one time settlement between the complainant and Ops for payment of Rs.48,000/- and that complainant was required to repay that amount in three installment on the dates stipulated in that document. The complainant has admitted except paying the first installment on the due date has not paid the subsequent two installments and has not paid lesser amount then what was required to be repaid. Conditions of this document provide if the repayment as scheduled under this document is not made the bank will not accept the subsequent payments towards one time settlement. Therefore, complainant having violated the terms of one time settlement cannot make allegations of deficiency against the Ops in their not accepting repayment of the balance adhering to settlement. Therefore, complainant who has breached the condition of the settlement cannot come up with this complaint with an allegation of deficiency. Therefore, complaint is dismissed at the stage of admission as it lack merits.
