In this case the OP was proceeded exparte on 12.08.2008.
The case of the Complainant, in nutshell, is that he had a account with the OP from September, 2004 and he had a credit card facility from the OP. He had not received the statement of account from 16.06.2007 to 15.09.2007 and he had paid the minimum amount to the OP. He had requested several times to the OP to furnish the statement of account but he had not received the same. He had been overcharged by the bank. The prayer of the Complainant is that “I should be granted relief for overcharging, humiliation and torture following unfair trade practice, deficiency in service and false promises by agent of the HDFC Bank. I pray to provide relief against HDFC Bank. They should be penalized for overcharging and torturing me following unfair trade practice, deficiency in service and for making false promises, so that a customer does not have to undergo agony and tension by credit card.”
The Complainant filed the exparte evidence wherein the prayer of the Complainant is vague. He has not sought any specific relief against the OP and also the Complainant has not mentioned any unfair trade practice and/or deficiency in service on the part of OP. Therefore, the complaint is not specific. We are of the opinion that the Complainant has failed to prove any unfair trade practice on the part of OP. Therefore, we dismiss the complaint with no order as costs.
Let a copy of this order be sent to the parties as per regulation 21 of the Consumer Protection Regulations. Thereafter file be consigned to record room.
