1.                Complainant claims to be having saving bank account No.01121050017784 with OP at Khanna. Even he has been holding credit card No.4854991700094799. On the bill of said credit card of complainant for the month of January 2016 and February 2016, there was an offer to get shopclue vouchers of worth of Rs.500/- on train ticket booking @ www.irctc.co.in valid till 31st March 2016. Complainant booked seven seats on the above said site in two different sets i.e. one in set of four and second in set of three on 29.2.2016. So, complainant claims to be entitled to receive two shopclue vouchers of worth of Rs.500/- each, but despite that he has not received the same, even though he called upon OP on helpline number in March 2016 and subsequently also. On call in March 2016, representative of OP assured that vouchers will be delivered to the complainant after 31.3.2016, despite that those were not delivered till 7.4.2016 and that is why, complainant sent emails on the address of Op. Ticket numbers even were provided, but despite that nothing done by the OP. Then a complaint was lodged by the complainant on email, but to no effect. On complaint made through telephonic call on helpline number of OP, complainant was informed that his grievance will be redressed within 7 working days, but to no effect and after serving legal notice, this complaint filed for deficiency in service. Directions sought against OP to provide two shopclue vouchers of worth of Rs.500/- each. Compensation for mental harassment of Rs.15,000/- even claimed.

2.                Op is ex-parte in this case.

3.                Complainant in ex-parte evidence tendered his affidavit Ex.CA along with documents Ex.C1 to Ex.C7 and then closed the ex-parte evidence.

4.                Oral arguments were then heard and records gone through carefully.

5.                Perusal of Ex.C3 to Ex.C5 each reveals that an offer on the credit card was provided with respect to delivery of two shopclue vouchers of worth of Rs.500/- on train ticket bookings @ www.irctc.co.in. That offer was valid till 31.3.2016. Complainant claims to be holding the credit card through which he purchased the tickets in two sets on 29.2.2016 and relevant copies of purchase transaction produced on record as Ex.C5. This Ex.C5 discloses as if two sets of tickets through irctc.co.in were purchased of worth of Rs.788.82P and Rs.1043.97P by the complainant on 29.2.2016. In view of this certainly the complainant became entitled to concession of availing two shopclue vouchers of worth of Rs.500/- as per terms and conditions of offer annexed with Ex.C3 to Ex.C5. Those two shopclue vouchers were not provided to the complainant and that is why, he sent emails Ex.C6 and Ex.C7, but despite that response was not received and as such, it is obvious that OP has violated the terms and conditions of the offer by not providing the vouchers in question to the complainant. So, deficiency in service on the part of OP certainly is there, particularly when those offer given by OP bank itself through Ex.C3 to Ex.C5 each. Complainant on account of non receipt of these vouchers suffered somewhat mental agony and as such, by keeping in view the price of the vouchers, for which, entitlement of the complainant is there, meager amount of compensation for mental harassment and agony of Rs.1000/- allowed. Complainant himself appeared and as such, litigation expenses of Rs.1000/- more allowed in his favour and against OP.

6.                As a sequel of the above discussion, complaint allowed ex-parte in terms that OP will provide two shopclue vouchers of worth of Rs.500/- each to the complainant within 15 days from the date of receipt of copy of this order. Compensation for mental harassment and agony of Rs.1000/- and litigation expenses of Rs.1000/- more allowed in favour of complainant and against OP. This amount of compensation and litigation expenses be paid by OP to the complainant within 30 days from the date of receipt of copy of this order. Copies of order be supplied to the parties free of costs as per rules.

7.                File be indexed and consigned to record room.
