Case called out. Both the parties are present through Counsel. We have already heard the Learned Counsel for the parties on the application dated 06/07/2018 which is for withdrawal of the present complaint. The Learned Counsel for the opposite party has opposed this application. The complainant has moved this application on the ground that, in view of the law laid down by the Hon’ble National Commission in case no.97/2016  Ambrish Kumar Shukla & Others V/s Ferrous Infrastructure Pvt. Ltd. [2016(4) C.P.R.83 (N.C.T.)] the pecuniary jurisdiction of the District Consumer Forums has been taken away in the matters having valuation exceeding Rs.20 lakhs and therefore, the present complaint is not cognizable by this Forum for inherent lack of pecuniary jurisdiction. We have gone through the aforesaid pronouncements of the Hon’ble National Commission and found that, the present complaint is not triable by this Forum for inherent lack of pecuniary jurisdiction.  In view of the above, we find it appropriate to permit the complainant to withdraw her complaint. This application is allowed accordingly. The complainant is permitted to withdraw the present complaint for filing before appropriate Forum. Both the parties shall bear their own costs. Let record be consigned.
