As per order-sheet dated 11/01/2010 appellant who was appearing in person had carried out the amendment to the cause title of the appeal memo.  So, respondent Nos.3&4 are newly added respondents, but no service has been effected on them.  He was directed to issue notice through the Commission and also private notice was permitted.  He has done neither.  Today, he is absent.  Counsel for respondent Nos.1&2 Mrs.Anita Marathe is present.  It is 11.38 a.m. now, still appellant is not present.  Hence, we pass the following order :-

                   -: ORDER :-

1.       Appeal stands dismissed for default.

2.       No order as to costs.

3.       Copies of the order be furnished to the parties.
