Arguments on application for discovery for document of OP no.4 not ready. It is stated by counsel for the OP no.4 that this complaint is premature as complainant has never submit the alleged claim/document with the insurance company whereas complainant has stated that they had submitted the claim alongwith all relevant documents to the insurance company but they have not decide their claim and hence they have to file this complaint.
The only dispute in this complaint is whether complaint has submitted their claim to the OPs but there is no documentary proof on behalf of complainant regarding submitting their claim to the OPs. After hearing the counsel for both the sides at some length, it is noticed that complainant be given an opportunity to submit their claim to the OPs and on receipt of the claim, OPs shall decide the claim of complainant within a specific period. Upon which counsel for both the parties agreed at bar.
The complaint of the complainant stands dispose off with direction that complainant shall submit their claim alongwith relevant documents through registered post as well as personally to the HDFC ERGO General Insurance Company Limited, having its office at 208, 2nd floor, Sewa Corporate Park, Mehrauli Gurgaon Road, Gurugram, Haryana122001 from today within a month and on receipt of the said claim of the complainant, the insurance company shall decide the claim of the claimant within two months. It is ordered and Complaint stand dispose off accordingly. File be consigned to the record room after due compliance.
