CC No.305 of 2020.

Ajay Malik     Vs.        HDB Financial.

 

Present:     Complainant with Sh. SS Saini, Adv.

                  Sh. Kapil Dhawan, authorized representative of HDB Financial Services for the respondent with Sh. Sumit Gupta, Adv.

 

                 On the basis of even dated application filed by the complainant, case file taken up on today. Parties have entered into amicable settlement. Sh. Kapil Dhawan, authorized representative of HDB Financial Services, in terms of authority letter dated 20.07.2022 from the respondent, appeared before this Commission and stated, on sale of tractor bearing registration No. HR-71F-2308, the sale proceeds shall be adjustable towards the outstanding loan arrears against the complainant and the adjustment of the sale proceeds of the tractor shall be treated as full and final settlement of the claim and the respondent will issue No Dues Certificate to the complainant within 60 days and any litigation pending in any Court of Law against the complainant shall be withdrawn by the respondent. Complainant agreed to the statement of representative of the respondent.

                 Keeping in view the statement of complainant and representative of the respondent, without making any adverse comment on the act and conduct of the respondent, matter being amicably settled, present complaint is partly accepted, permitting the respondent to sale the tractor, bearing registration No.HR-71F-2308 and sale proceeds shall be adjusted by the respondent as full and final settlement of arrears of loan pertaining to loan account No.3203213 and the respondent shall issue No Dues Certificate in favour of the complainant, within 60 days from the date of this order. Any another litigation between the complainant and the respondent regarding loan account No.3203213, if any pending before any Court of law or any another Authority, shall be withdrawn by the respondent. Parties are left to bear their own cost of litigation. File be consigned to the records.
