22.9.2023 Present: Sh. N.K. Garg counsel for applicant.
Ld. Counsel for applicant filed an application dated 20.9.2023 for correction in the order dated 25.8.2023. In the application it is alleged that the above noted complaint was decided by this Commission on 25.8.2023 vide which the Commission directed the opposite parties No. 1 & 2 to cancel the hypothecation of the vehicle and issue Form No. 35 for the cancellation of hypothecation of vehicle in question after settlement of loan amount, if any. It is further alleged that due to typographical mistake, the registration number of the TATA Truck not mentioned in the entire order and for the compliance of the said order it is very much necessary to mention the registration number of the TATA Truck, so in the interest of justice, the registration number of TATA Truck bearing No. PB-19-F/8905 (as Ex.C-2) may kindly be added in the order dated 25.8.2023. 
We have gone through the facts of the application and also gone through the Section 40 of the Consumer Protection Act, 2019 which read as under;-
“The District Commission shall have the power to review any of the order passed by it if there is an error apparent on the face of the record, either of its own motion or on an application made by any of the parties within thirty days of such order”
Therefore, we are of the view that this Commission has passed the above said order on 25.8.2023 and the complainant/applicant has filed the present miscellaneous application on 20.9.2023 within the period of 30 days of such order. Moreover, if the registration bearing number PB-19-F/8905 of the TATA Truck mention in the order dated 25.8.2023 it will be helpful for the settlement of loan amount, if any and it will cause no loss to any of the parties. Therefore, we allow the present miscellaneous application of the complainant/applicant to the extent of mentioning the TATA Truck bearing number PB-19-F/8905 in Para No. 8 of the order dated 25.8.2023 in Consumer Complaint No. 253 of 2022. This present miscellaneous application be also attached with the main case file. Further, the revised copy of the order dated 22.09.2023 alongwith copy of this order be supplied to the parties free of costs as per rules. File be consigned to records after its due compliance.
