1.     Heard Shri L.R. Goel, Counsel for the Appellant.

2.     The appellant has impugned the orders dated 08.05.2013 passed by the Ld. District Forum-X vide which the applicant was proceeded against ex-parte.

3.      The reason given for absence on the relevant date is that the Counsel for the appellant was held up in the traffic jam. We have no reasons to disbelieve the contention put forth by the Counsel for the Appellant.  In the circumstances and in the interest of justice, appeal is allowed setting aside the ex-parte orders dated 08.05.2014 subject to payment of costs of Rs.2,000/-.  Case is remanded back to the District Forum (X), New Delhi with the directions that Appellant/OP shall file his written version. Matter shall be decided after hearing both the parties. Parties to appear in the District Forum (X), New Delhi on the date already fixed i.e. 9.12.14.

5.   A copy of this order be sent to District Forum (X), New Delhi for compliance.
