(1)               As per the order sheet dtd.09/05/2007, we were reported by the Adv.M.V.Masurkar for the appellant that the respondent/original complainant was dead, so she wanted to bring legal heirs on record.   Hence, for taking necessary steps, the matter was kept on 01/08/2007.  Then, on 23/01/2008, the matter again appeared before us and respondent was reported dead and appellant was directed to take steps by way of last chance and adjourned to 02/04/2008.  On 02/04/2008, board was discharged and since 09/05/2007 til this date, no application has been filed for bringing legal heirs of the respondent/original complainant by the appellant.  More than 4 years have passed.  As such for not bringing legal heirs of the respondent on record, the appeal is liable to be dismissed.  Hence, we pass the following order.

ORDER

1)       Appeal stands dismissed.

2)       No order as to costs.

3)       Inform the parties accordingly.
