The First Appeal No.1355/2005 directed against the order of the District Forum in Consumer Complaint No.514/2000 was disposed of on 22.11.2007.  Instead of filing the review petition in this Commission, petitioner filed Civil Misc. Application No.143/2009 on 28.1.2009 seeking review of the order dated 22.11.2007 on the ground that a ‘Compromise’ had been arrived at between the parties

-2-

in the Mega Lok Adalat held on 19.12.2008 and, therefore, the order dated 22.11.2007 be recalled and the appeal be disposed of as per terms and statements of both the parties recorded in Mega Lok Adalat on 19.12.2008.  The State Commission dismissed the Civil Misc. Application by its impugned order dated 08.4.2009.  On being asked to produce the terms of settlement arrived at before the Mega Lok Adalat on 19.12.2008, learned counsel appearing for the petitioner states that the settlement had been arrived at in some other case and not in the present case.  If that so, then the Revision Petition filed against the order dated 22.11.2007 is hopelessly barred by time and the Revision Petition against the order dated 08.4.2009 passed in Misc. Application would not be maintainable.  Dismissed.
