                   Shri Rishi Ram Sharma, counsel for JDs.

         

        Today the execution application is fixed for compliance of order as well as for filing reply to show cause notice.

        Learned counsel for JDs placed on file letter memo No.816 dated 18.03.2021 and a copy thereof also supplied to the decree holder.

                Decree holder suffered his separate statement to the effect that as per letter memo No.816, dated 18.3.2021, he withdraws his execution application as partly satisfied subject to realization/recovery of his balance amount, if any, found due towards the JD. He further submitted that he is not satisfied to the letter written above stating as reserving the right to recover the compensation amount, once the 5^th enhancement is already admitted by the Hon’ble Authority.

                Heard.

                In view of statement of DH, the present execution application is dismissed as withdrawn. However, the DH reserves the right to file fresh execution application in future in case JDs does not fully comply the order dated 29.05.2009, passed by this Commission. File be consigned to the record room after due compliance.
