            Rameshwar Vs. HUDA

 

Present:          Sh.Rameshwar, DH in person.

                        Sh.M.K.Munjal Advocate for the JD

           

                        File taken up today on the application of DH Rameshwar for releasing the amount and to furnish the surety bonds.  Report of Assistant perused as per which a cheque no.500747 dated 04.01.2021 for Rs.429750/- has been produced by the bank before this Commission on dated 06.01.2021 and the same is placed on file.

                        Mrs. Kavita (surety of DH) made a statement that in the present case if opposite party makes an appeal before the higher Court and if the order is passed against the DH, then she will be liable to refund the received amount. Requisite Surety bonds have been furnished, which are accepted and attested today.

                         DH Rameshwar made a statement that he has received a DD No.500747 dated 04.01.2021 amounting to Rs.429750/-(Rupees four lac twenty nine thousand seven hundred and fifty only) and in case order has been passed against the DH by the higher Court, then he will be liable to refund the whole amount. So he does not want to proceed with the present execution subject to clearance of DD.

                        In view of the statement made by DH, present execution stands dismissed as withdrawn, subject to clearance of DD.
