Complainant/petitioner sowed 5 bags of wheat purchased from the respondent containing 40 kg in his fields.  The seeds did not germinate.  Petitioner filed the complaint before the District Forum.

          District Forum partly allowed the complaint, aggrieved against which respondent filed the appeal before the State Commission.

          State Commission has reversed the order of the District Forum.  State Commission in its order has held that the expert evidence

produced by the petitioner did not support his case; that to the contrary, the report submitted by the petitioner supported the case of the respondent that there was no defect in the seeds supplied by the respondent.

          We have perused the expert report.  The report instead of supporting the case of the petitioner negates his case.  The report clearly states that there was no defect in the seeds supplied by the respondent.  No case for interference is made out.  Dismissed.
