Complaint presented today. It be checked and registered.
The complainant has filed the present complaint under Section 35 of the Consumer Protection Act, 2019 against the opposite parties (hereinafter referred to as OPs) on the averments that the complainant is an agriculturist since long and he has taken the agricultural land measuring six acres on lease situated in village Sidhpur Tehsil Nilokheri, Karnal. The complainant has purchased two bags of PR-114 seed at the rate of Rs.850/- per bag weighing 10 Kg each, vide invoice serial no.27910 dated 13.05.2023 from the opposite party no.1 for sowing the same in his said land situated in village Sidhpur Tehsil Nilokheri, Karnal. The same was sown in his aforesaid six acres of land properly and proper care was taken prior to sowing the said seeds and after sowing seeds properly as the complainant is an agriculturist since long.
But despite of proper care, watering, etc., the complainant was astonished to see that some of the crop reached the stage of maturity/pakai and some of the crop is at the stage of non-maturity/unprepared as such the complainant approached the opposite party no.1 and asked about the same. On the said application of the complainant a team of the Agricultural Department, Karnal visited the aforesaid land fields of the complainant on 12.09.2023 and inspected the fields land of the complainant and a report no.5644 dated 29.09.2023, wherein it has been clearly mentioned that 30-35% crop has been prepared/ready and 60-70% crop is not ready/prepared i.e., the said seeds are of duplicate, mix and inferior quality. Hence, this complaint.
Argument on point of admissibility heard.
Complainant has alleged that he has taken a land on lease but he has failed to place on record any proof with regard to the land taken on lease. Complainant has purchased 20 Kg seeds for six acres which is not sufficient for six acres of land. Moreover, the inspection report submitted by the Agricultural and Farmers Welfare Departments, states that 30-35% of PR-114 variety were ready whereas the other variety which constituted around 60-70% the plants are still green and not ready. The damage can be properly assessed only after reaping the crop. A list of 24 farmers was given to the committee who had purchased the seeds of the same lot. 15 farmers were contacted telephonically and it was found that no compliant regarding the seeds has been submitted by them. Thus, in view of the above, the complaint is devoid of any merits and deserves to be dismissed and same is hereby dismissed inlimine. Parties concerned be communicated of the order accordingly and file be consigned to the record room.
