Usha Rani Versus Haryana Sales.

 

Present:       None for the complainant.               

                   Shri Shekhar Kapoor, Adv. for OP No.1.

                   Shri Dheeraj Sachdeva, Adv. for OPs No.2 & 3.

         

                    Today, the case was fixed for appearance of complainant or his counsel. However, case has been called several times since morning, but again on today, complainant failed to appear before the Commission, either, in person or through any advocate, up to 03:30 PM. Further wait is unjustified. Perusal of case file shows that from the last two dates of hearing i.e. 25.04.2022 and 02.05.2022 respectively, complainant failed to appear before the Commission, either, in person or through any advocate. Non-appearance of complainant on today as well as for the last two dates of hearing, means, complainant is no more interested in pursuing the present complaint, therefore, the present complaint is hereby dismissed, for want of prosecution. However, in the interest of natural justice, permission is granted to the complainant, to file afresh complaint, if he so desires or advised. Certified copy of this order be supplied to the parties concerned, as per Rules. File be consigned to the records, after due compliance.
