Today, neither learned counsel for the appellant has appeared, nor the appellant has taken steps for service of notice upon respondents for hearing of delay condonation application.

It appears that the appellant is not interested to contest the delay condonation application.

In the above circumstances, the delay condonation application is hereby dismissed in the absence of appellant as well as for want of prosecution.  Consequently, the appeal also stands dismissed, being barred by limitation.  No order as to costs.

File be consigned to the record room along with copy of this order.

A copy of this order be sent to the concerned District Commission for perusal, information and necessary action.
