The complainant has filed the present complaint under section 12 of Consumer Protection Act, 1986 hereinafter to be referred as the ‘Act’ against the Opposite Parties, hereinafter to be called as OPs. The brief facts as alleged in the complaint are that the complainant had purchased a refrigerator make LG from OP-1 for a sum of Rs.27,300/- on 29.5.2013. The abovesaid refrigerator was purchased with a warrantee of one year for refrigerator and six years with regard to compressor.  It is alleged that there was problems with the compressor of the refrigerator. During the proceedings of this case efforts by the Forum were made to get the matter settled.  The OPs have replaced the compressor with a new one and refrigerator is working in satisfactory condition.  On 1.4.2016 the complainant admitted the facts that the compressor has been changed and the refrigerator is working in satisfactory condition but pressed for award of compensation.  OPs have also filed the copy of the job sheet which shows that the compressor was replaced on 12.2.2016 and gas was also filled.  The job sheet bears the signature of the customer.

2.     The short question before us is regarding the quantum of compensation to be awarded to the complainant.  At the outset it is mentioned that the OP has been fair in his conduct. In our view taking into consideration all the facts and circumstances of the case, the interest of justice would be met if the complainant is awarded a sum of Rs.5,000/- as compensation towards  harassment and mental agony which will be payable by OPs jointly and severally.  Ordered accordingly.

Copy of the order be sent to the parties as per rules.
