                Mr. P.K.Jha for OP.1

    Ms. Nandita Kukreja for OP.2

The complainant in this case had last appeared on 13.02.2020 when an application for dismissal of the complaint was filed by the OP No.1 on the ground that the vehicle has been sold by the complainant.  Thereafter corona pandemic struck. As per the application filed by OP.1, the vehicle bearing No.DL10CA 0698, the bone of contention of the present proceedings,  has since been sold by the complainant to one Mr. M.Jagdeesh. A copy of the present vehicle registration status has also been filed along with the application. Counsel for the OP No.1 has sought dismissal of the  complaint  by relying upon the judgment   of the Hon’ble National Commission in the case of Tata Motors Ltd Vs. Hazoor Maharaj  Baba Des Rajji Chela Baba Dewan Singhji, 2013 SCC Online NCDRC 883 wherein  it was held that since the complainant has sold the vehicle, the complaint is rendered infructuous as the complainant is no more a consumer.

Having gone through the averments made in the application, the complaint is dismissed as infructuous. File be consigned to record room.
