Heard. Learned counsel for respondent states that he has no objection, if the impugned order passed by the State Commission is set aside and written statement of appellant( who was opposite party before the State Commission) may be taken on record, subject to payment of costs. In view of the above statement given by learned counsel for respondent, the impugned order of the State Commission is set aside. Written statement to be filed by the appellant is ordered to be taken on record by the State Commission, subject to the payment of costs of Rs.5,000/-. Parties are directed to appear before the State Commission on 3.7.2012. On that day, appellant shall file its written statement with copy to the respondent. Costs shall also be paid on that day. In case, appellant fails to comply with the aforesaid directions, no further opportunity shall be given to the appellant. Appeal stands disposed off accordingly. Dasti.
