ORDER

Complainant  Bechu Yadav has filed this complaint case against Hamara India credit co-operative Society Ltd. for a claim of Rs. 5,63,281/- with Interest @18 % along with compensation of Rs. 1,00,000/- and litigation of Rs. 25,000/-.

2          The case of the complaint in short is that complainant has deposited sum of Rs. 1,71,094/- on 10-09-2016 in the scheme of “F64 Golden A Double” fixed deposit which receipt no. is 665014562467 certificate N0. 465002648237, Membership No. 61156006701 and on 10-09-2016 for Rs. 1,69,172 in the Scheme “ F64 Golden A Double” which receipt No. 665014562466, certificate no. 465002645236, membership no. 61156006701, and15-09-2016 a sum of Rs. 1,73,053/- for said scheme which receipt No. 665013803725, certificate no. 465002250394 and Membership no. 61156006971 and on 09-08-2018 for Rs. 50,000/- for same scheme which receipt No 438001679295, Membership No. 611158002829 in total Rs. 5,63,281/-

A certificates Rs. 5,63,281/- in total were issued in the name of vide certificate No. 465002648236, 465002250394 and 438001679295.

3          On 01-10-2018 a hand written petition has been filed by the complaint before O.P. No.2 for withdrawal of some money for the purpose of self marriage.

            But O.Ps has not paid the money demanded, for this complainant has suffered mental and physical harassment.

4          The complainant has filed tracking report which shows that the Notice has been served to the O.Ps. but they have not appeared in this forum. The matter has been fixed for ex-party hearing.

5          Complainant has filed certificate marked Anx-1 to 1/4 only.

F I N D I N G S

7          We perused the record. Complainant is consumer and dispute is a Consumer Dispute and within Time.

8          We perused the documents filed by complainant and it appears that  Rs 5,63,281/- in total has been deposited by the complaint with the O.P. and certificates in this regard has been issued by the O.P. The O.P. have not paid the amount along with others to the complainant in spite of demand.

9          therefore, we allow the claim of the complainant and directed O.P. M/s Hamara India Credit co-operative Society Ltd. the amount in total Rs. 5,63,281 (Rs. Five lac sixty three thousand two hundred eighty one) only with interest accrued since 10.09.2016 on Rs. 1,17,094/- and Rs. 1,69,132/- on 15.09.2016, on Rs. 1,73,055/- and 09.08.2018 on Rs. 50,000/- which all are unmatured certificates till 01.10.2018 when the complainant has demanded money.

            O.P. is further directed to pay Rs. 2000/- (Rs. Two thousand) only as compensation and litigation cost Rs. 1000/- (Rs. One thousand) only to the complainant.

            All the payments must be paid within 60 days of this order, failing which the rate of interest shall be enhanced to 10% per annum till realization.

            O/C is directed to deposit the record in the record room.
