F I N A L O R D E R
- The instant case was filed by complainant U/S 12 of the C.P. Act, 1986 wherein the complainant has prayed for direction upon the o.p. to deliver vacant possession of the schedule mentioned flat after receiving the balance amount and to pay compensation to the tune of Rs. 30,000/- and litigation costs of Rs. 5,000/- as the o.p. in violation of the agreement dated 11-03-2013 for sale of the schedule mentioned flat to the complainant.
- Notice was properly served upon the o.p. As the o.p. did not appear in spite of several dates the matter was heard ex parte.
3. Two points arose for determination :
i) Is there any deficiency in service on the part of the O.P. ?
ii Whether the complainant isentitled to get any relief as prayed for ?
DECISION WITH REASONS :
- Both the points aretaken up together for consideration. On scrutiny of the papers it appears that the complainant filed T.S.No. 15 of 2014 before the Ld. 4th Court ofCivil Judge, Jr. Division, Howrah, with respect to the suit property.The copy of the order sheet of the civil suit reflects that the complainant ( plaintiff ) already paid Rs. 5,12,500/- out of the agreed amount of Rs. 10 lakhs. Perused the deed of agreement. We have no hesitation in our mind with respect to the payment ofRs. 5,12,500/-. As the o.p. turned a deaf ear to the request of the complainant, we are of the view that this is fit case where the prayer of the complainant shall be allowed. Both the points are accordingly disposed of.
Hence,
O R D E R E D
That the C. C. Case No. 377 of 2014 ( HDF 377 of 2014 ) be and the same is allowed ex parte with costs as against the o.ps.
The O.P. be directed to deliver possession of the schedule mentioned flat to the complainant within 30 days from the date of this order after receiving the balance amount of Rs. 4,87,500/-.
The o.p. be further directed to pay a sum of Rs. 20,000/- as compensation for causing mental pain and prolonged harassment and Rs. 5,000/- as litigation costs within the period as mentioned above.
The complainant is at liberty to put the decree into execution after expiry of the appeal period.
Supply the copies of the order to the parties, as per rule.
