Sagarika Sarkar, Member – This instant case is filed u/s-12 of the C.P. Act, 1986 by the complainant Amit Kumar Sen, Son of Arun Kumar Sen alleging deficiency in service on the part of the above mentioned O.Ps.

The complainant entered into an agreement with the O.P. no.2, developer of a proposed land, on 27/06/2013 and as per terms of the agreement he paid Rs.1,05,000/- to the O.P. no.1 owner of the land who after receiving the said amount issued receipts of payment on 14/07/2014. It is stated in the petition of complaint that the complainant made payment of entire installments as per terms of the agreement and after making such payment at last he made contact with the O.Ps. by making several calls and sending Advocate’s letter dated 07/07/2017 and went to the proposed sites but found no development work was done by the as per terms and conditions of the agreement. It is further stated in the petition of complaint that the complainant on several occasions requested the O.Ps. to refund the money as per clause no.12 of the said agreement but O.P. did not turn up which compelled the complainant to file this instant case. Accordingly the complainant has prayed for direction upon the O.Ps. to execute and register the sale deed or to pay Rs.3,50,016/- to the complainant with compensation and other reliefs.
Registered notices were served upon the O.Ps. Inspite of service of notices none appeared on behalf of O.Ps. hence the case was proceeded ex-parte against them.
To prove his case complainant has examined himself and filed some documents.
Decision with reason.
Admittedly the complainant entered into an agreement with the O.Ps. Complainant paid the installments as per terms and conditions of the agreement. After payment of all installments complainant intended to visit the allotted plot of his where he found no development work was done. On perusal of Bank pass book and Advocate’s letter dated-7.7.2017 it appears that complainant paid all installments @Rs.6806/- per month from May 2013 to April 2016 i.e. 36 installments. Further it appears from the Agreement for Sale, Clause No.4 that “the FIRST PARTY shall complete all necessary works of the said land within three years from the date of execution of this agreement, and the date of execution of the agreement was on 27.6.2013 and after passing of more than 4 years O.Ps.neither started the development work nor did they refund the received amount of the complainant which clearly indicates the violation of terms and conditions of the agreement by the O.Ps. and which tantamounts to deficiency in service on the part of the O.Ps.

In view of our above findings we are of opinion that the complainant’s case is proved and O.Ps. are liable to refund the money received from the complainant with 18% interest p.a. as per terms & conditions of the agreement on the amount w.e.f. dates of respective payments of installments.
In the result the complaint case succeeds.
Hence, it is,
ORDERED.
that the Complaint Case No.44/2018 is allowed exparte against the O.Ps. with cost.
O.P.No.1 is directed to pay Rs.3,50,000/-along with interest @18% p.a. from the date of each payment till realization to the complainant. O.P. No.1 & 2 are jointly and severally directed to pay Rs.7,500/- towards litigation cost within one month from this date of order failing which entire amount shall carry interest @10% p.a.
