The complainant on the strength of this complaint has claimed that the opposite parties be directed to pay a compensation of Rupees 80,000/- on the grounds that he agreed to supply electricity in 90 shops of 90 shopkeepers in a fair named ‘Gugga the Fair’ for which he obtained electricity connection vide electricity No. GBCT-6 on depositing of Rupees 4500/- as meter charges from the opposite parties on 02-09-2014, but the said meter became defective due to wrong fitting of the electricity meter by the opposite parties due to which he could not maintain proper supply to the said shopkeepers during one day and one night and thereby suffered a loss of Rupees 60,000/- on account of loss on receipt of rent and also suffered harassment, inconvenience and mental tension.
2. In view of the aforesaid averments, it is apparent that he had obtained the electricity connection for commercial purpose . He has nowhere claimed that he availed the services of the opposite parties for earning his livelihood exclusively for self employing him, as a result of which this Forum is bound to conclude that the complainant had obtained the electricity connection for commercial purpose hence he does not fall within the definition of consumer as envisaged under Section 2(1)(d)(ii) of the Consumer Protection Act, 1986 and as such the complaint is not maintainable.
3. In view of the aforesaid findings the complaint is not admitted and dismissed being not maintainable. However, the complainant is at liberty to approach the appropriate Court for seeking his remedy, if advised so. Let certified copy of this order be sent to the complainant free of cost, as per rules. The file, complete in all respects, be consigned to the Records.
