BY THE STATE COMMISSION ( PER HON'BLE MRS. JUSTICE NISHA GUPTA,PRESIDENT):

 

This appeal has been preferred against the order dated 14.8.2015 of the court below.

 

The short facts of the case are that the appellant has took a personal loan of Rs. 1 lakh from the respondent which was to be paid in 12 instalments. The contention of the appellant is that he had paid Rs. 5247/- extra which has to be re-paid to him.

 

Heard the counsel for the appellant and perused the order of the court below.

 

The court below has rightly held that after calculation it has been revealed that Rs.5247/- has not been paid excessively.

 

The contention of the appellant is that in different instalments this amount has been paid excess but the court below has considered the seven cash receipts paid by the appellant and it has been checked with the loan statement submitted by the respondent and thereafter it has been rightly found that Rs. 18432/- are not been entered in the loan account.

The court below has not found any excess payment of Rs.5247/- after scrutiny of statement of account, hence no relief has been rightly allowed on this point.

 

There is no infirmity in the order of the court below. The appeal is liable to be rejected.
