ORDERED

That the complaint be and the same is allowed on contest against op no.1 with cost of Rs. 10,000/- but same is allowed exparte against op no.2 but without any cost.

Op no.1 is hereby directed to refund the entire amount of Rs. 2,65,400/- to the complainant with interest at the rate 8 percent p.a. over the same with effect from 26.02.2013till its full payment to the complainant.

For causing mental pain and sufferings and also for adopting unfair practice and to help the op no.2 to withdraw the same, op no.1 shall have to pay a sum of Rs. 25,000/- to the complainant as compensation.

For adopting deceitful manner of service and for giving false statement by the op/bank before this Forum and for adopting such unfair practice op no.1 is imposed penal damages of Rs. 30,000/- which shall be paid to this Forum’s account and it is imposed only to check such sort of unfair practice as adopted by the op no.1 even before this Forum for filing false statement in the written version.

Op no.1 is hereby directed to comply the order very strictly within 15 days from the date of this order failing which for non-compliance and disobeyance of the Forum’s order within the stipulated period, penal interest at the rate Rs. 200/- per day shall be paidby the op no.1 till full satisfaction of the entire decree and if it is collected, it shall be deposited to this Forum even if op no.1 fails to comply the order in that case op no.1 shall be prosecuted u/s 27 of C.P. Act 1986 for which further penalty and fine may be imposed.
